Website service agreement

The plain terms for the websites we build and look after for you, on a pay-as-you-go basis. The short version first; the detail follows.

The short version

  • The quote and the 30-day mock-up are free, with no obligation. If you don't go ahead, the mock-up simply comes down.
  • If you do, it is pay as you go: from NZ$0.75 a day to NZ$4 a day depending on what your site does, monthly, every 6 months or yearly (paying ahead costs less), in advance, with no contract.
  • From Business up, 5 help requests a month are included, each up to 30 minutes; after that, or on Essential, a request is NZ$30, shown before you send it. Urgent problems and faults are always free, and bigger work is quoted first.
  • Cancel any time from your account. You won't be charged again, and your site stays live to the end of the month you have paid for.
  • Your domain name stays yours, and so do your words, photos and logo: download them from your account any time.
  • Urgent problems answered within four working hours; everything else within two working days.
  • We give you 30 days' notice of any price change, and you can leave before it applies.

1. Who this agreement is with

This agreement is between you and HATTECH Limited, a New Zealand company based in Christchurch ("HATTECH", "we"), which runs My Front Page. It covers the websites we design, build, host and look after for you ("your site"). You accept it when you tick to accept and subscribe, for yourself or for the business you name.

2. The free mock-up

Asking for a quote or a mock-up costs nothing and commits you to nothing. A mock-up is online for 30 days for you to try. During those days you can send us changes with the Feedback button on the mock-up, and we make reasonable changes so you can judge it properly. If you don't subscribe by the end of the 30 days, the mock-up is taken offline. Nothing is charged and you don't need to tell us.

We use the words, photos and files you send only to make your mock-up and your site. By sending them you confirm you have the right to use them, and that they don't break anyone else's rights.

3. Pay as you go

Your site is a month-to-month service with no minimum term. The price follows the plan that covers the features on your site, from NZ$0.75 a day (Essential, NZ$22.50 a month) to NZ$4 a day (Premium, NZ$120 a month), and is shown before you pay. Every site starts at NZ$0.75 a day. You can add features to your plan at any time from your account: the new price is shown, it applies from the day you accept it, and the difference for the rest of that month is added to your next payment. Where a feature needs setting up on your site, we do that for you and email you when it is ready. If a one-off setup fee has been agreed for your site, it is shown before you pay and is charged once, with the first month. Your first month is paid when you subscribe, and each month after that is paid in advance on the same date, by card or Apple Pay, through our payment provider Stripe. Or you can pay ahead: every 6 months, for five and a half months' price, or yearly, twelve months for the price of eleven. You can change how often you pay from your account at any time: the new period starts that day, and what is left of the one you paid for is taken off. We never see or store your card details. Prices are in New Zealand dollars and include GST where it applies. You get a receipt by email for every payment, with a PDF copy, sent to you or to a billing email address you choose in your account.

4. What the monthly price includes

Hosting your site on our infrastructure, a secure connection, keeping the software up to date and secure, backups, and fixing anything of ours that goes wrong. Features on your plan (such as enquiry email, live visitors, content management, an online shop, push notifications or interactive features) are included as shown when you subscribed.

From the Business plan up, help when you need it is included: 5 requests a month for small changes and questions, each up to 30 minutes of our time, answered by the people who built it. The 5 start again on the 1st of each month (New Zealand time); unused requests don't carry over. Once the 5 are used, each further request is NZ$30, shown before you send it, and added to your next payment only if you accept. The Essential plan has no requests included, so each one is NZ$30, shown before you send it. Urgent problems (your site is down, or customers can't order, pay or get in touch), faults in what we built, setting up a feature you add, and anything during your free trial never count and are never charged.

Before a request reaches us, it is checked straight away: if it is something you can do yourself in your admin, you are shown how, and nothing is used. A bigger piece of work, such as a redesign, a new kind of page or a new component, is a design request: we send you a quote first, and nothing is charged unless you accept it.

New pages, new features or design changes beyond what was agreed are quoted first, and you can always say no. If a change moves your site to a different plan, we tell you the new price before anything changes.

We answer urgent problems within four working hours (8am to 6pm, Monday to Friday, New Zealand time), and everything else within two working days. If we are away, your account and our replies say until when, and urgent problems are still looked after.

4a. Space, visitors and limits

Each plan includes photo space for your site: Essential 1 GB and up to 300 photos, Business 2 GB and 500, Business Plus 5 GB and 1,000, and Premium 10 GB and 2,000. Your admin shows how much you have used. Photos can be up to 8 MB each, in JPEG, PNG, WebP or GIF, and are made smaller as you add them. During the free trial a site has room for 30 photos (50 MB). There is no limit on visitors and no charge for traffic. If you need more space, ask us: we will tell you the price before anything changes.

4b. Fair use

Your site must be for a real business or organisation, in its own name. It must not ask people for passwords, card or bank details, pretend to be another business or person, offer investments, loans or prizes it can't honour, or carry anything unlawful, adult, or harmful. A free mock-up whose details look like one of these waits for us to look at it before it is made, and we tell you if we can't host it. Anyone can report a site to us at myfrontpage.website/report; if a report looks right, we may take the site offline while we look into it, and we tell you why.

5. Your domain name

A domain name registered in your name stays yours. After you subscribe it comes across with one change: your DNS stays where it is, you point www to your new website with the CNAME record we give you, and forward the domain itself to www. Your email and everything else on the domain stay as they are. Your site goes live when the change has spread, and we email you when it does. We can talk you through it. Registering or renewing the domain itself stays with you and your registrar, unless we agree otherwise.

When you leave, we help you point your domain somewhere else.

6. Cancelling

You can cancel at any time from your account, with no fee and no notice period. Cancelling stops all future payments. Your site stays live until the end of the month, 6 months or year you have already paid for, then goes offline. Until then you can change your mind and keep your site from the same page. Because each payment is in advance, we don't refund part of a period, except where the law requires it.

7. Missed payments

If a payment doesn't go through, we email you and Stripe tries again over the following days. You can change your card from your account at any time; when you do, any payment that is due is tried again on the new card straight away, and every payment after that comes from it. If a payment is still unpaid 14 days after it was due, your site goes offline until it is paid, and the service may end. If a payment is reversed or disputed with your bank, we may take your site offline while it is resolved.

8. When the service ends

We keep your site and its content for 30 days after it goes offline, and email you a week before it is deleted. If you subscribe again in that time, we bring it straight back. After 30 days it is deleted, with its photos; a site still owed for has its subscription ended then too. You can download everything on your site (its words, photos, enquiries and receipts) from your account at any time, and delete your account there once nothing is being paid for.

9. Your content and our work

Your content (your words, photos, logo and other material you give us) stays yours, and you allow us to use it to run your site. The design and software we build, and the infrastructure it runs on, stay ours, and you have the use of them for as long as you subscribe.

We may write first drafts of your words for you, with the help of AI, from what you tell us. Please read them: what your site says is yours to check, as if you had written it yourself, and you can change any of it in your admin. You confirm you have the right to use the photos and words you put on your site.

Your site must not be used for anything unlawful, misleading or harmful (see 4b). If it is, we may take it offline and will tell you why.

10. Changes to prices and this agreement

We email you at least 30 days before any change to your price or to this agreement, saying what changes and when. If you don't agree, you can cancel before the change applies, with no fee.

11. Your rights under New Zealand law

Nothing in this agreement takes away rights you have under New Zealand law that can't be taken away, including under the Fair Trading Act 1986. If you are in business and use our services for the purposes of your business, you agree that the Consumer Guarantees Act 1993 does not apply, to the extent the law allows. This agreement is governed by New Zealand law.

12. Responsibility

We take care to keep your site online and working, but no service can promise to be available all the time. To the extent the law allows, we are not responsible for indirect losses such as lost profits, and our total responsibility to you is limited to the amount you paid us in the three months before the problem arose. This doesn't limit responsibility for fraud or for anything the law doesn't allow to be limited.

13. Privacy

We keep your name, contact details, the material you send and your billing history to provide your site, bill for it and support you. Payments are handled by Stripe. We don't sell or share your details for anyone else's marketing. You can see, download, correct or delete what we hold about you, as the Privacy Act 2020 allows: our privacy policy sets out what we keep, for how long, and who helps us.
